How Much is Your Personal Injury Case Worth?

Every case is different, but there are several general rules that can be used to "evaluate" a personal injury case.

1. "Value" is ultimately determined by a jury. Whether a case ever gets to a jury trial does not change the fact that everyone involved in your case attempts to determine the value of the case through the eyes of 12 potential jurors. This includes insurance companies, your attorney, and it should also include you.

2. Determining who is that fault. Under Pennsylvania law, "negligence" is broken down in terms of percentages. This is true whether the case is tried in front of a jury or for purposes of valuing the case at any time during settlement negotiations. Starting at 100%, the jury (and also an insurance company as well as any attorneys involved in the case), must determine who is at fault and also must determine their degree or percentage of fault. The defendant may be 100% at fault or may be found to be less than 100% at fault. A plaintiff, you, may also been found to be at fault. This is typical in a situation where the plaintiff is one of the drivers in the accident and there's a dispute as to how the accident occurred, or it is also typical in a situation where the plaintiff is claiming an injury because he or she fell on someone else's property. In those types of situations the defense argues that the plaintiff was some degree of fault. So long as the plaintiff is not found to be 51% or more negligent, the plaintiff is generally entitled to "recover" or be compensated for his or her injuries. For instance, if the jury finds the injured plaintiff to have injuries that are evaluated at $1,000 but finds the plaintiff 50% at fault, the plaintiff is awarded $500 in terms of a jury verdict. As another example if the jury finds the plaintiff to have injuries that they feel should be valued at $1,000 but finds the plaintiff 10% at fault, the plaintiffs is awarded $900 in terms of the jury verdict. Both sides go through this exercise throughout the settlement negotiations.

3. Medical bills, lost wages, future lost wages, and "out-of-pocket" expenses. These items are also used to evaluate a personal-injury case. Typically unpaid medical bills are what a jury will see. Judges usually do not allow juries do see the full amount of the medical bills if some of those bills were paid by other insurance coverage. An itemization of the time you missed from work, what that cost you, as well as what might be expected in future lost wages is also an "element" of damages. In addition, any "out-of-pocket" expenses are also items for which you can seek reimbursement. Nira Thomas fell flat on her back after sliding on the ice on your insured's property. She immediately made an appointment with Dr. Jess P. Jones and was seen by him later that day. Ms. Thomas received chiropractic treatments from Dr. Jones on January 9, 11, 17, 29 and February 5, 2001. Because the pain was not abating after these treatments, Ms. Thomas requested a referral to an orthopaedist. The pain actually got worse during the first six weeks after the accident. The injury was exacerbated in the first two months by the physical and emotional stress of Ms. Thomas's work responsibilities, which as detailed below, she was unable to substantially curtail.

Dr. Leroy Hamm examined Nira Thomas on February 12, and March 14, 2001. Dr. Hamm's reports document that Ms. Thomas had been having some lower back pain just prior to this accident. The accident of January 9, 2001 exacerbated her lower back pain, causing it to radiate to her right buttock. Dr. Hamm diagnosed Ms. Thomas as having suffered a lumbo sacral strain. He prescribed medication and a lower back physical therapy program. My client took medication for several months in conjunction with physical therapy, reducing the medication as tolerable.

Ms. Thomas began receiving physical therapy on February 15, 2001 at Nova Care. She treated consistently through May 18, 2001. Ms. Thomas received additional treatment at Physical Therapy Now from May 21, 2001 to December 4, 2001. It was only this physical therapy which provided significant relief to my client.

Ms. Thomas was examined by her internist, Dr. William Schetzy in the Fall of 2001. The report he prepared for the U.S. Department of Labor is enclosed.

Note that Nira Thomas continues to this day to suffer considerable back pain and has significant limitation in her activities of daily living as the result of this accident. She takes pain medication typically on an intermittent basis, and on a daily basis when the pain is exacerbated. She does exercises at home and receives massages from her husband, Robert.

The marital strain on both of my clients, sexual, emotional and physical from the time of this accident, has been great. In addition to the daily marital and personal and work stresses Ms. Thomas has been under, the delay in pursuing her biological reproductive objectives greatly impacted and continues to impact my clients to this day. Financially, emotionally, physically and spiritually, it has been devastating.

Following the accident, Ms. Thomas's supervisor would not permit her to substantially reduce her total weekly hours or work responsibilities for many weeks, until she was determined to be qualified under FMLA. In extreme pain in January-March, 2001, Ms. Thomas alternated standing and sitting at her desk, attempting to work on the computer. She was unable to sit for more than 10-15 minutes at a time. It was only after the FMLA qualification was submitted to the Human Resources department, that her supervisor was obligated to reduced Ms. Thomas's hours and shift some of her work load to another employee. Until then, Ms. Thomas simply worked through the pain.

Another work consequence of the injury was that this supervisor did not allow Ms. Thomas to pursue professional development training programs in the Spring of 2001. My client had previously signed up for these programs but could not attend them because of her decreased hours. This loss of professional development for Ms. Thomas has impacted her earning horizons. Ms. Thomas loss in productivity after the accident was a major reason that she did not get a raise or cost of living increase during her annual review in July, 2001.

"Three conditions must exist before the surviving party or witness is disqualified: (1) the deceased must have had an actual right or interest in the matter at issue, i.e. an interest in the immediate result of the suit; (2) the interest of the witness -- not simply the testimony -- must be adverse; (3) a right of the deceased must have passed to a party of record who represents the deceased's interest." In every litigation matter, the courts require that certain documents be filed with the court. This includes the document you file to initiate the lawsuit, all motions, petitions, pleadings and stipulations. Until recently, filing was done in person, by mail or through filing services.

It is becoming more common for the courts to require electronic filing of documents. In federal court this is already mandatory for attorneys. If the court in which your litigation is pending requires e-filing, you must learn the procedure. You may have to purchase a program like Acrobat Writer to create documents in PDF format.

It took me about two hours to figure out how to e-file in federal court. The Court of Common Pleas of Philadelphia is rapidly moving toward e-filing. It will be interesting to see how efficiently the new system is put into place. Once you clear the hurdle of learning the system, e-filing is a real time and money saver.

Another big advantage of e-filing is that you can file at the very last moment. If a certain document must be filed by no later than July 30, you don't have to worry about overnighting the document on July 29. You can e-file up until 11:59 p.m. on the 30th. Check your court's website for details about e-filing.

In Federal Court, e-filing is already mandatory for lawyers. If you don't have a lawyer, there may be more leniency. You can expect the same from the state courts, although each one has it's own policy.

In every insurance claim, you need to set forth your claim in the strongest and clearest possible language. Here is a sample settlement demand letter.

Dear Ms. Insurance Adjuster:

Elizabeth Hoffman, age 39, was severely injured on the above date when she slipped on ice that your insured failed to clear from its parking lot. I enclose a receipt showing a transaction at your insured's business that morning shortly after the fall. Ms. Hoffman was a business invitee at the time, and thus entitled to the highest protections under the law. Your insured was under an affirmative duty to protect my client not only against dangers which its employees knew about, but also against those which with reasonable care one or more of its employees might have discovered. Ms. Hoffman slipped on an unsalted patch of ice as she exited her car. You are already in possession of a weather report showing that the last snow was two days earlier.

Ms. Hoffman broke her fall with her hands. She immediately felt a strong pull on the left side of her lower back and upper left leg along with pain on the right side of her neck and right arm. She got up slowly and went into the store , informing a female employee that she had fallen outside.

After my client went home, she applied ice, took Ibuprofen and rested. She began to feel pain in the arch of her left foot at that time. When she awoke the next morning, her entire lower back was hurting. As the day went on, her neck and right arm pain increased. On the morning of the 19th, the pain in her neck and arm had worsened. As the day continued, she remained in bed and found that her whole lower back was throbbing. She went to see her primary doctor, Dr. Wood, complaining at that time of pain in the left buttocks, left arch, right arm and right side of the neck. She had lower back pain and spasm with forward flexion. Dr. Wood prescribed physical therapy.

During the following week, Ms. Hoffman took medication but suffered from bouts of pain in her right arm and hand, right and left arches, and lower back. She began physical therapy on January 25, 2005 and was given home exercises. The most significant problems for the remainder of the month were her arches, right hip/pelvis, right arm and lower back. Through February, March and April, my client suffered pain and/or sensitivity in the lower back, right arm/shoulder, neck, left and right arches and right hip/leg. She experienced numbness and tingling in the right foot and leg. She also experienced great discomfort with sitting and lying down. Standing brought some relief. Ms. Hoffman received physical therapy from January 25 to March 21, 2005.

Frank called a while back and asked about firing his lawyer. He complained that his lawyer "wasn't doing anything". I frequently receive this kind of call, but rarely do I take the case. It is no pleasure generally to be the second lawyer in on a personal injury case. You must get it right the first time. Here's why I usually turn these cases down.

The most frequent reason is that the case isn't very strong, either in terms of liability, damages or both. In other words, it's a bad case. Lawyers, especially overworked lawyers, tend to neglect bad cases. So the first thing that pops into my head when I get a phone call complaining that a lawyer is neglecting a client is that there are major problems with the case.

The next most frequent problem is the client. Most clients are wonderful to work with. But some are unreasonable in their expectations, discourteous, overly demanding, etc. Lawyers tend to react badly to such clients. The lawyer may neglect the file simply because he dislikes the client. If I sense that the client is going to be impossible to satisfy, I am not going to take the case. Whenever I am approached by a client who wants me to take a case over, I consider this possibility.

Another issue is that I will have to pay the first lawyer out of my fee for the time he spent on the case. The case therefore needs to be quite strong on both liability and damages. If there's "not enough to go around", I may make a business judgment not to take the case. That leaves the client with an upset first lawyer and a case in legal limbo. And the client is left with little choice but to continue lawyer shopping. That's the risk you run when you pick the wrong lawyer.

Finally, especially if the first lawyer is not a PI specialist, the file may not have been well handled. Picking up the pieces is not always so easy. Some mistakes are irreparable.

Treat your selection of a personal injury lawyer the way you would any matter of importance in your life. It is crucial to make the right choice in selecting an attorney, the first time.

Insurance companies react to a change in lawyers in various ways. They may view the switch as a sign that the case and/or the client is in trouble. This can result in increased reluctance to settle and a stepped up investigation into the merits of the case. Injuries suffered on leased premises present certain difficulties for plaintiffs. "The law is clear that a landlord out of possession is generally not liable for bodily harm sustained on his property by his tenant and those on the premises under his tenant's right when he is entirely out of possession and control. Craig v. Ryan, 191 A.2d 711, 713 (Pa. Super. 1963)(emphasis added).

Whether a landlord is out of possession or in possession is a fact specific issue. For example, one factor is whether the landlord makes repairs to the property. See Henze v. Texaco, Inc., 508 A.2d 1200 (Pa. Super. 1986); Pierce v. Philadelphia Housing Authority, 486 A.2d 1004, 1005, (Pa. Super. 1985). In Pierce, the fact that PHA took care of maintenance and collecting rent created an inference not only of possession and/or control by PHA, but also of responsibility to keep the stairways of the property in good repair.

In all of the cases where the court has determined that the landlord was "out of possession", there was a lease between the parties. The Superior Court likens a lease to a sale, with responsibility for defects passing to the tenant unless otherwise provided for in lease. Kobylinski v. Hipps, 519 A.2d 488 (Pa. Super. 1986).
Where a contract is silent as to the subject of maintenance of the leased premises, and where the defendant performed needed maintenance during the period of the lease, there arises a "necessary implication" that the defendant had a duty to maintain the premises in good repair and reasonably safe for use by the tenants. McDevitt v. Terminal Warehouse Company, 450 A.2d 991, 998 (Pa. Super. 1982). How much moreso is this true in the case where there is no evidence of a lease at all.

Further, even if it were determined that the landlords were "out of possession", there are several exceptions to the rule that attach liability to an out of possession landlord. Kobylinski v. Construction work site injuries are governed by common law and statute. Common law is the body of law created by judicial decisions and statutory law is the body of law created by statute. A plaintiff may seek financial recovery under the common law tort theories of negligence and premises liability. A plaintiff may also seek relief through statutory employment law remedies like workers compensation.

Negligence

A construction worker injured on a work site may sue for negligence. Negligence occurs when a person fails to exercise the standard of care that a reasonable, prudent person would have exercised in a similar circumstance. In order to recover, the following must be proven:

(1) The defendant owed a duty to the plaintiff;
(2) The duty was breached;
(3) The breach was the actual and proximate cause of the plaintiff's injury; and
(4) The plaintiff suffered personal or property damage.

All people owe a general duty to act in accordance with how a reasonable, prudent person would in a similar circumstance. As such, reasonable, prudent people take precautions against unreasonable risks of injury to others. If unreasonable risk of injury to others occurs, a general duty of care is owed from the defendant to the plaintiff. No duty, though, is owed from the defendant to the plaintiff for unforeseeable risks. A higher standard of conduct applies to people who have special skill or knowledge above an ordinary person. For example, as opposed to acting as a reasonable person would, a general contractor must act as a "reasonable contractor" would.

Premises Liability

Construction injury law is also governed by premises liability, which is based on general principles of negligence. Premises liability law governs the duty that occupiers and land possessors owe to entrants on a property. A land possessor is not always the landowner. For example, a general contractor in charge of a construction project may be considered the land possessor. This duty exists regardless of ownership because the person in possession of the land is considered the best equipped to control and discover any dangerous conditions. A land possessor has a duty to maintain the property in a way that does not endanger others.

The difference between premises liability and negligence is that negligence places a general duty on all people to act reasonably and avoid foreseeable harm to others, while premises liability does not impose a general duty to act non-negligently. Rather the duty of due care depends on the relationship between the entrant and the land possessor. There are four types of entrants: invitees, children, trespassers, and licensees. Construction workers are considered business invitees. A business invitee is a person that enters the premises at the request of and for the purposes of the possessor. Consequently, possessors owe a duty to protect invitees against known dangers or dangers that can be reasonably discovered. Since premises liability is based on the possessor's negligence, unforeseeable risks or defects, or obvious risks that an invitee could have reasonable discovered, do not subject the possessor to liability.

Employment Law

Initially, common law governed the duty of an employee to provide a safe workplace as well as safe tools and equipment. The ineffectiveness of common law courts to provide legal remedies led to the creation of workers compensation statutes. State statutes determine worker compensation benefits. Workers compensation ensures that workers receive payment for lost wages and medical expenses. Relief can include medical care, temporary disability, permanent disability, and vocational rehabilitation.

Workers compensation laws affect potential legal claims. Employees receive benefits regardless of the employer's fault or the employee's own negligence. Because benefits are granted without determining fault, in most cases employers are protected from lawsuits from employees. Employees, though, may bring a lawsuit against a third party, such as the manufacturer of a defective product.

Violations of Statutes: OSHA

Occupational Safety and Health Act (OSHA) regulations are the most common safety regulations imposed on construction work sites. Federal laws promulgated under OSHA are in place to regulate workplace safety and health, and to enforce safety standards. Regulations entitle workers to a workplace free of known hazards. The land possessor is responsible for implementing OSHA regulations.

While OSHA violations do not create a private cause of action, many courts allow the admission of OSHA violations as proof of a defendant's duty and breach of duty in negligence lawsuits. For example, OSHA regulations can be used to show evidence of a standard of care or to show a violation of a regulation. At the same time, proof of compliance with OSHA does not relieve a defendant from a finding of negligence.

Who Can Be Liable?

To determine the liable party, it is necessary to ascertain the amount of control the individual retained over the premises of the construction site and over the performance of the work. As discussed, the amount of control over the work site helps to determine the land possessor, and thereby determine the liable party. The following duties apply:

• Landowners: In general, a landowner has a duty to protect guests from harmful conditions on their property. However, landowners are not always considered the land possessor. This determination depends on the degree of control that the landowner has on the premises during the construction project.

• General Contractors and Sub-Contractors: General contractors and sub-contractors have a duty to make certain a construction site is safe, warn of defects, hire competent employees, and comply with safety regulations.

• "Prime Contractors": A Prime contractor's duty only applies to the portion of the project hired to perform or for the work that is delegated to sub-contractors.

• Construction Equipment Manufacturers: Manufacturers may be liable for the construction of faulty equipment. In this situation, a product liability claim may be brought against the manufacturer.

Such injuries may be sustained by unrestrained or improperly restrained occupants who slide forward in the seat during pre-crash braking, unconscious drivers who are slumped over the steering wheel, and properly restrained drivers who sit too close to the steering wheel.

Children under 12 should always be restrained in a rear seat. A rear-facing infant restraint should never be put in the front seat of a vehicle with a front passenger air bag. Such a restraint places an infant's head close to the air bag module.
